Victoria Sturdy Photography Session Contract

 

A. Session Fees

Client agrees to pay a creative session fee to book a session and reserve a spot on the Victoria Sturdy Photography newborn calendar. This is a non-refundable fee that covers the time and talent of photographer, use of props, and creative editing of images, as determined by the photographer.   No print products or digital files are included with this fee.  Print products and digital files will be available for purchase during the viewing/ordering session.  Please be sure to review all pricing details. Pricing information will be discussed during the pre-session consultation and will be emailed to the client for reference.  There are no refunds or exchanges of any kind due to the custom nature of portrait photography.  

B. Rescheduling

If an illness or situation prevents a photo session from taking place, the client may reschedule the session at least 24 hours prior to the shoot without penalty.  Should the client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. The photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control.

C. Re-shoots / Refunds

Re-shoots are determined at the discretion of the photographer. There are no refunds.

D. Archive

After thirty (30) days, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

E. Payment

All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.  All payments must be cleared before any products can be ordered.

F. Damage

The photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by UK mail. Client assumes all responsibility for the safety of all portraits upon receipt.

G.  Your Session

Newborn, Baby, and Glamour are conducted at the photographer's home studio located at 34 Thornton Close, Girton, Cambridge Cambridge CB3 0NG or an outdoor location within Cambridge. A travel expenses fee will be charged for locations outside Cambridge. Toddler and children's session can also be shot on location around Cambridge.

Clients should be prompt for the session.  The photographer has scheduled around the "sleepiest" times.  Newborn sessions begin at about 10:00 am.  For newborn sessions the photographer allows a 30 minute cushion (between 10:00 and 10:30 am) as getting out of the house with a new baby can be difficult.  Arriving late to the appointment will result in lost session time.  If the client is running late, he/she must notify the photographer.  The session may need to be rescheduled if the client arrives over 30 minutes after the scheduled start time.  If the client fails to show for the scheduled appointment or the session has to be rescheduled due to tardiness, an additional £150 deposit will be required to reschedule.  

The client should take the time to review samples of the photographer's work to make sure that her style of photography and editing is a good fit (these can be seen at lostadventurersphotography.zenfolio.com/ or facebook.com/victoriasturdyphotography  When a client books with with  Victoria Sturdy Photography , he/she gives the photographer full reign over session styling and artistic editing of photos.  The photographer will be choosing the props that will be used and the best of the images to edit and present so if the client has specific likes or dislikes these should be discussed well in advance of the session.  It is the photographer's goal to provide all clients with pictures that they will love.  Her newborn editing workflow includes brightening, removing any baby acne and prominent skin flakes, reducing redness and yellowing caused by jaundice, softening skin to even out blotchiness and give a smooth texture, and sharpening to bring out features.  If either parent is opposed to any of this, her style of photography may not be a good fit. Better to discuss this now then after the session as there are no refunds.

H.  After the session

At the time of the session a viewing/purchasing session will be scheduled (within two weeks). At this time (and only this time) the image gallery will be presented and products may be purchased.  All parties that will need to be involved in purchasing decisions must be present (no online galleries will be made available and additional viewing appointments will incure a £100 fee).  Please note, again, there no refunds or exchanges on fees paid due to the custom nature of portrait photography. 

I. *Online Sharing*

Only images that are watermarked and specially formatted for web viewing by Victoria Sturdy Photography can be posted or shared online.  Images may not be altered in ANY way by the client (no cropping, black/white conversion, filters, etc.).  Clients may NOT post the high resolution print files online.  Clients are advised to turn off Facebook's "photo enhancement" feature before posting images as it will greatly distort the image quality.

J. Model Release

I hereby give to Victoria Sturdy Photography and photographer Victoria Sturdy the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child: 

a) To copyright the same in the photographer’s name or any other name that she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, display, Etsy, portfolio, competitions, vendor publication or publication to promote the studio and; 

I hereby release and discharge Victoria Sturdy from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

K. Liability

The photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release the photographer from any claims against their person or their business.  The Client(s) will waive, disclaim and release Victoria Sturdy Photographyand its respective owners, members, employees, agents, volunteers and representatives from any and all actions, claims or demands that they may have now or in the future, whether known or unknown, against the Victoria Sturdy Photography Parties, including without limitation those related to injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.

L.  Indemnification

The client hereby agrees to indemnify and hold harmless the Victoria Sturdy Photography Parties from all liabilities, losses, claims, costs (including attorney’s fees and court costs), damages or expenses of whatever nature that may result from injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto. 

M. Copyright & Penalty

Victoria Sturdy Photography retains all copyrights to all images created during client’s session. A print release will be provided with digital files to print portraits for personal use. The print release does not allow publication of the portraits (i.e. entering in contests), selling or altering of the images without the photographer’s written permission. 

N.  Sneak Peaks and Facebook Sharing

Victoria Sturdy Photography will post a favorite shot(s) from the session on the Facebook fan page once product purchases have been made and encourages the client(s) to tag himself/herself and share with friends and family.  Please note that clients are allowed to use these on their Facebook Profile as long as the watermark remains fully intact, and the photo is not altered or cropped in any way.  

O.  Refund Policy

The Client(s) hereby agrees that he/she fully understands that there are no refunds or exchanges on purchases due to the custom nature of portrait photography.

P. Session Requests

*Please ensure that you have reviewed the tips for a successful newborn session found on the "Newborn Session" page at lostadventurersphotography.zenfolio.com/ and follow the recommendations therein.

*Please ensure that the baby is in good spirits and is well-rested and fed before the session.

*Please make sure the baby's hair is combed and face is clean and free of a runny nose or goopy eyes.

*Be prepared to work hard to get smiles and to get the baby's/toddler's attention...it is very difficult to do this from behind a camera so much of that responsibility will fall to the parent.

*Please discuss outfit planning before the session.  Cute outfits can make a session (and a less-than ideal outfit can result in less-than-optimal images).

Q. Camera Policy

Cameras, camera phones, camcorders or any other recording equipment is NOT Permitted during any session, either in the studio or on location, without the express permission of Lost Adventurers Photography

IMAGES ARE KEPT FOR A SIX MONTH PERIOD AT THE DISCRETION OF VICTORIA STURDY PHOTOGRAPHY

R. Retouching

It is not possible for your photographer to know how you prefer to look, and as a lifestyle photographer I am shooting you in a natural manner in your home or  on a outdoor location and can not spend the time in your shoot adjusting your hair or clothing to ensure it is perfect to you as every person prefers something different, please ensure you look the way you would like to in the photos before I take them as I can only re edit 2 free of charge after the shoot. After that a fee of £50 per edited image

S. Special Requests:

1.) Please reschedule if your baby is ill. A runny nose is very difficult to edit and a sick baby is generally not going to be his/her normal happy self. 2.) Please be sure to clean the baby's face thoroughly to remove food residue and clean crusty noses before we begin.

3.) Please bring a non-messy snack and bottle or sippy cup or be prepared to nurse if needed.

Please check below, sign  and submit this form to begin booking your session. The booking process will be complete and your spot will be reserved on the Victoria Sturdy Photography calendar once this contract and your session fee are received. *

I have read and understand the terms of this portrait contract with Victoria Sturdy Photography

We have understood the contents of this contract and agree to the terms therein.

If you want to cancel your contract with Victoria Sturdy Photography you have a 14 days cooling off period where your booking fee will be refunded. If you wish to cancel the contract after 14 days the booking fee is non-refundable, the session can be rescheduled and the booking fee is transferable for one session and needs to be booked within a year of the original booking
